The WSG essentially argues that we should trust the executive branch as they arrest people (and there's no restriction against the same treatment being extended to American citizens) in the country. Just because the executive says they are enemy combatants, does not mean they are; that's what trials are for.

All the judges said is that the guy's got right to a trial. I don't buy the argument about national security -- there are ways to protect evidence (like, not disclosing it to congress). So give him a trial. If he's guilty, throw away the key.

I actually don't believe the judges are wrong. The president can't arbitrarily suspend constitutional protections. I think this will make for an interesting case on appeal.
